Dental Care in Jails and Prisons: Common Legal Issues and Ways to Avoid Them

The primary focus of this presentation would be a discussion about those legal issues that consistently occur in the provision of dental services to the incarcerated population. A number of these issues would include continuity of care, preventative care, delays in cavity treatment, medications, referrals to off-site oral surgeons, the intersection between dental care and medical care, charting issues, dental hygiene, and dental procedures. We will discuss common themes underlining these issues. Potential legal pitfalls, such as the timeliness of care. As well as some tips and strategies to help prevent or limit future liability when providing dental care to the incarcerated population.
